GRAPHTEC SOFTWARE LICENSE AGREEMENT (GSLA)

IMPORTANT! READ CAREFULLY: This Graphtec SOFTWARE License Agreement ("GSLA") is a legal agreement between you (either an individual or a single entity) and Graphtec Corporation for any and all Graphtec software product(s) accessible via this web site or any Graphtec controlled server, which includes computer software and may include associated media, printed materials, and "online" or electronic documentation ("SOFTWARE"). By downloading, installing, copying, or otherwise using the SOFTWARE, you agree to be bound by the terms of this GSLA. If you do not agree to the terms of this GSLA, you may not use the SOFTWARE.

  • You may permanently transfer all of your rights under this GSLA, provided you retain no copies, you transfer all of the SOFTWARE (including all component parts, the media and printed materials, any upgrades, this GSLA, and, if applicable, the Certificate of Authenticity), and the recipient agrees to the terms of this GSLA.
  • Without prejudice to any other rights, Graphtec may terminate this GSLA if you fail to comply with the terms and conditions of this GSLA. In such event, you must destroy all copies of the SOFTWARE and all of its component parts.

SOFTWARE Ownership

Any software ("Software") that is made available to download from this server, or any other server under the control of Graphtec or its subsidiaries, is the copyrighted work of Graphtec Corporation and/or its subsidiaries or suppliers. Use of the SOFTWARE is governed by these Terms of Use and GSLA contained therein.

The SOFTWARE is made available for downloading solely for use by customers of Graphtec Corporation and/or its subsidiaries, distributors, authorized agents or representatives or suppliers, according to this GSLA. Any reproduction or redistribution of the SOFTWARE not in accordance with the Terms of Use is expressly prohibited by law. You may not download or install any SOFTWARE from this server unless you agree to these Terms of Use in their entirety.

No Warranties

Graphtec Corporation hereby disclaims all warranties and conditions with regard to the Software, including implied warranties and conditions of merchantability, fitness for a particular purpose, title, and non-infringement.The SOFTWARE and any related documentation are provided "as is" without warranty of any kind. The entire risk arising out of downloading, installation, use, or performance of the SOFTWARE remains with you.

No Liability for Damages

In no event shall Graphtec or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this Graphtec product, even if Graphtec has been advised of the possibility of such damages.
